DECREE OF THE MINISTER OF AGRICULTURE
No. 506/KPTS/SR.140/2006
ON
REGISTRATION OF PESTICIDES FOR EXPORT
THE MINISTER OF AGRICULTURE,

Considering :

a. that, some countries stated their intention to import pesticides registered in Indonesia with certain conditions;
b. that, eleven (11) applications for registration of pesticides submitted were already evaluated and they are declared as having fulfilled the conditions stipulated for pesticides for export;
c. that, based on the above matters, it is deemed necessary to register pesticides for export;

In View of :

4. Law No. 8/1999 on Consumer Protection;
5. Government Regulation No. 7/1973 on Monitoring of Circulation, Storage, and Use of Pesticides;
6. Government Regulation No. 6/1995 on Plant Protection;
7. Government Regulation No. 74/2001 on Treatment of hazardous and Toxic materials;
8. Government Regulation No. 49/2002 on Tariff of Non Tax State Revenue Applicable within the Ministry of Agriculture juncto Government Regulation No. 7/2004;
9. Presidential Decree No. 187/M/2004 on Establishment of United Indonesia Cabinet;

Observing :

Opinion of Pesticides Commission in its letter No. 724/KOMPES/2006 dated August 9, 2006

DECIDES :

To stipulate :

DECREE OF THE MINISTER OF AGRICULTURE ON REGISTRATION OF PESTICIDES FOR EXPORT

Article 1

(1) Eleven (11) pesticides, as specified in Column 2, are registered with numbers of registration as specified in Column 5, on behalf of the holders of certificates of registration, as specified in Column 4 of Attachment to this Decision, may only be exported, and may not be circulated and used domestically.

(2) The pesticides, as meant in paragraph (1), in accordance with the data and information given in the applications for registration , contain active materials and are in the form of formulations, as specified in Column 2 and Column 3 of Attachment to this Decision.

Article 2

(1) The certificate of registration, as meant in Article 1, is valid for five (5) years, and can be extended.

(2) Repeat registration of the pesticides, as meant in paragraph (1), must be proposed in writing before the term, as specified in paragraph (1), expires.

Article 3

(1) The holders of the certificates of registration, as meant in Article 1 paragraph (1), must:

a. Guarantee that qualities of pesticides, in accordance with data and information given in the applications for registration;
b. Guarantee that the containers, wrappers, and labels of pesticides are in accordance with Decree of the Minister of Agriculture No. 434.1/KPTS/TP.270/7/2001 on Conditions and Procedures of Registrations;
c. Convey annual report on operation of export of pesticides to the Minister of Agriculture via the Director General of Food Plants.

Article 4

For certain purpose based on importer's request, the Minister of Agriculture may consider change of names, containers, and labels of the pesticides, as meant in Article 1 paragraph (1).

Article 5

The certificate of registration, as meant in Article 1 paragraph (1), is invalidated if :

a. The pesticide is no longer in compliance with the data and information written on the application for registration;
b. The pesticide is proven as hazardous to human health and the environment, and this matter has not been found out before;
c. The pesticide is circulated and/or used domestically, and/or there is violation of the applicable laws;
d. The holder of certificate of registration did non convey report of operation of export of pesticide for two (2) years consecutively.

Article 6

This Decision comes into effect since the date it is stipulated.
